Terms and conditions

These terms describe how personalised songs are requested and purchased through NuestraCanción. Please read them before placing an order.

1. Who we are and scope

The service is operated by the business identified above (the “Provider”). These terms apply to browsing the site, creating a free preview and purchasing a personalised song. A consumer’s mandatory statutory rights are not limited by these terms.

2. The service and previews

You provide a story and select the recipient, musical style, vocal preference and lyrics language. The service creates a personalised lyric and musical production, which may use generative tools and human review depending on the chosen pack.

The song demonstration on the home page is a fictional, digitally generated sample. It is not a real customer order, review or guarantee that another song will sound identical. Your free preview is produced for the details you submit; preview audio, duration, voice and arrangement can differ from the final reviewed delivery.

Lyrics may be requested in Spanish, English, Catalan, Galician, Basque or French. AI-assisted results can vary in pronunciation, wording, melody and arrangement. The selected pack’s advertised features are the features included in your order.

3. Packs, prices and delivery

• Essential pack: €14.90, including VAT, with a target delivery time of 72 hours.
• Emotion pack: €24.90, including VAT, with a target priority delivery time of 24 hours.
• The delivery period begins once payment is confirmed. The expected time is an estimate; if an issue may delay delivery, contact the customer by email.
• The total price and selected pack are shown before payment. No optional add-ons are included unless expressly displayed in the checkout.

Payments for current orders are processed securely through Stripe when it is configured. A bank authorisation or return to the site is not, by itself, proof that an order has been paid; payment is confirmed by the payment provider.

4. Ordering and digital-content consent

Submitting the creation form requests a free preview and does not charge you. A paid order is placed only when you select a pack and complete the payment flow. Before paying, the checkout asks you to accept the purchase terms and separately to request immediate commencement of the digital song service.

Where Article 103(m) of Spain’s consolidated Consumer Protection Act (Royal Legislative Decree 1/2007) applies, immediate commencement of non-material digital content requires your express prior consent, acknowledgement of the applicable loss of the withdrawal right once execution has begun, and the confirmation required by law. The separate checkout statement is intended to record that choice. It does not waive any mandatory conformity, refund or consumer rights that cannot legally be excluded.

If you do not give the required separate consent, the checkout cannot request immediate performance. For questions about withdrawal rights in your circumstances, contact the Provider before ordering or seek independent consumer advice.

5. Customer-provided content

You are responsible for the accuracy of names, stories, photos and other material you submit. You confirm that you are entitled to provide those materials and ask us to use them to fulfil your request. Please do not submit sensitive personal information, confidential information, or third-party content you are not authorised to use.

Photo use conditions

You must not ask the service to imitate a specific living artist’s voice, reproduce protected lyrics, or create unlawful, defamatory or infringing content. We may refuse or request changes to a prompt that creates a legal or safety concern.

6. Personal-use permission

Once the order is paid, the customer receives a non-exclusive permission to access, download and share the delivered song for personal, non-commercial use, subject to third-party provider rights and applicable law. Commercial use, resale, sublicensing, exclusive rights and use in paid advertising are not included unless separately agreed in writing. This wording does not assert rights that applicable law does not grant in AI-assisted output.

7. Changes, support and complaints

The preview may be regenerated up to the number of free attempts shown on the order page. Report a delivery problem or request a permitted correction at hola@nuestracancion.es, quoting the order email or order reference. Mandatory statutory remedies for lack of conformity remain available.

8. Privacy and external providers

Order details are used to create and deliver the song, manage payment, provide support and meet legal obligations. Depending on the selected production route, relevant story and lyric data may be processed by OpenAI, Mureka or Google/Lyria; payments may be processed by Stripe. 9. Availability and liability

We will take reasonable steps to keep the site available and fulfil paid orders. Short service interruptions, force majeure and failures of external providers may affect previews or estimated delivery. This does not remove mandatory consumer remedies or limit liability where such limitation is prohibited by law.

10. Governing law and contact

Spanish law applies without prejudice to mandatory consumer protections that apply in the customer’s country of residence. Consumers may bring proceedings before the courts available under applicable consumer law. Questions or complaints: hola@nuestracancion.es.
